Audience Notice, Assumption of Risk & Release of Liability - 2026 Peninsula Mid-Autumn Festival Gala
Event: Sunday, October 25, 2026, 3:00-5:00 PM|Venue: College of San Mateo Theatre, Music, Theater, Art Buildings, 1700 W Hillsdale Blvd, San Mateo, CA 94402|Organizers: FCCCEA & Arts Empower Life Foundation
Please read this agreement carefully before purchasing, especially Section 3 regarding the release of liability.
1. Voluntary Participation and Assumption of Risk
I voluntarily purchase tickets and attend this event. I understand that entering, attending, and leaving the event may involve risks including slips and falls, collisions, crowding, loss of personal property, and other risks associated with public places and live events. I am aware of these risks and will take reasonable precautions appropriate to my health and circumstances.
2. Safety Rules and Personal Responsibility
I agree to follow the venue rules and the organizers' reasonable safety instructions, to cooperate with staff for on-site management and emergency evacuation, not to enter unauthorized stage, backstage, or other restricted areas, and not to engage in conduct that endangers myself or others.
I will safeguard my belongings; if I notice a safety hazard or feel unwell, I will promptly notify staff. The organizers may take reasonable measures against anyone who disrupts order or endangers safety, including requiring them to stop or to leave.
3. Release of Liability and Its Limits
To the fullest extent permitted by California law, I voluntarily release FCCCEA, Arts Empower Life Foundation, and the directors, officers, employees, and volunteers of both organizers acting within the scope of their duties for this event, from civil liability that may lawfully be released for personal injury, death, or property loss caused to me by ordinary negligence during entry to, attendance at, or departure from this event. I understand that this provision may limit my right to bring claims for such matters.
This agreement does not release anyone from liability arising from gross negligence, reckless or intentional misconduct, fraud, or unlawful acts that may not be released by law, nor does it limit any rights I may not waive by law.
4. Minors and Purchasing for Others
Minors must be accompanied and supervised appropriately by a parent or legal guardian. The accompanying adult should help them follow on-site rules and provide reasonable supervision.
If I purchase tickets for another adult, I will provide this agreement to them for their own reading and confirmation. Purchasing on someone's behalf does not itself mean I am authorized to waive another adult's legal rights.
If I purchase tickets for a minor, the minor's parent or legal guardian should read and confirm the participation arrangements applicable to the minor. This agreement does not automatically constitute a waiver of a minor's independent claims.
5. Emergencies
In an emergency, the organizers and on-site staff may contact emergency responders and provide reasonable assistance within their ability, but do not guarantee professional medical services on site. Related medical and rescue costs are the responsibility of the person legally liable to pay or their insurer.
6. Program Changes and Ticket Policy
Program content, performance order, and performers may be reasonably adjusted as circumstances require. If the event is canceled, postponed, or materially changed, the organizers will notify attendees through the contact information provided at purchase or through the ticketing platform. Refunds, returns, and rescheduling are governed by the ticket policy clearly displayed before purchase and by applicable law. This agreement itself does not constitute a "no refunds" term.
7. Governing Law and Severability
This agreement is governed by the laws of the State of California. If any provision is held invalid or unenforceable, the remaining provisions remain in effect to the extent permitted by law.
